These Terms and Conditions (“Terms”) govern your use of the Seb Duper Photography website and services. By accessing our website, booking our services, or communicating with us, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

2. Services

Seb Duper Photography provides professional photography services, including but not limited to:

  • Event photography
  • Product photography
  • Corporate and branding photography
  • Portrait and headshot photography

Specific service details, deliverables, timelines, and pricing are agreed upon individually with each client and may be outlined in written proposals, emails, or invoices.

3. Bookings & Payments

  • A booking is considered confirmed once agreed upon in writing and, where applicable, a deposit is received.
  • Fees, deposits, and payment schedules will be communicated prior to the booking.
  • All prices are subject to applicable taxes unless otherwise stated.
  • Late payments may result in delayed delivery of final images.

4. Cancellations & Rescheduling

  • Cancellations or rescheduling requests must be made as soon as possible.
  • Deposits are non-refundable unless otherwise agreed in writing.
  • In the event of photographer cancellation due to illness, emergency, or circumstances beyond control, reasonable efforts will be made to reschedule or provide a suitable alternative.

5. Intellectual Property & Usage Rights

a) Ownership

All photographs and content created by Seb Duper Photography remain the intellectual property of Seb Duper Photography unless otherwise agreed in writing.

b) Client Usage

Clients are granted a non-exclusive, non-transferable license to use delivered images for their intended purpose (e.g., personal use, marketing, business promotion).

Images may not be:

  • Sold
  • Altered beyond basic cropping or resizing
  • Used for illegal, defamatory, or misleading purposes

without prior written consent.

c) Portfolio & Marketing Use

Seb Duper Photography reserves the right to use images for portfolio, website, social media, and promotional purposes unless the client explicitly requests otherwise in writing prior to the shoot.

6. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information
  • Secure permissions for locations, venues, or subjects where required
  • Ensure cooperation of participants during photography sessions

Seb Duper Photography is not responsible for missed shots due to lack of cooperation, late arrivals, or restrictions imposed by venues or third parties.

7. Limitation of Liability

To the fullest extent permitted by law:

  • Seb Duper Photography shall not be liable for indirect, incidental, or consequential damages
  • Liability is limited to the amount paid for the services giving rise to the claim
  • We are not responsible for loss or damage caused by events beyond our reasonable control (force majeure)

Nothing in these Terms limits liability where such limitation is prohibited under applicable law, including Quebec consumer protection legislation.

8. Website Use

You agree not to:

  • Use the website for unlawful purposes
  • Attempt to gain unauthorized access to systems or data
  • Copy, distribute, or exploit website content without permission

All website content is provided “as is” without warranties of any kind.

9. Privacy

Your use of our website and services is also governed by our Privacy Policy, which outlines how personal information is collected, used, and protected in accordance with Ontario and Quebec laws.
